Terms of Service

These Terms of Service ("Terms") govern your access to and use of the buenagames.io website and any game published by Buena Games, the game studio of Buena Labs Inc. ("Buena Games", "we", "our", "us") (together, the "Services"). Please read them carefully.

1. Acceptance of Terms

By using the Services you agree to these Terms. If you do not agree, do not use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian who agrees to these Terms on your behalf.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play our games on devices you own or control, for your own non-commercial use. Games distributed through the App Store are also subject to Apple's Licensed Application End User Licence Agreement; where that agreement and these Terms conflict for an App Store download, Apple's terms prevail to the extent of the conflict. Games distributed through Google Play are subject to the Google Play Terms of Service in the same way.

3. Acceptable Use

You agree not to:

• Cheat, exploit bugs for advantage, or use unauthorised third-party software to modify gameplay
• Reverse-engineer, decompile, or attempt to extract source code or assets, except where that right cannot be excluded by law
• Harass, threaten, or abuse other players, or post unlawful or hateful content in any social feature
• Sell, trade, or transfer accounts or in-game items outside mechanisms we provide
• Interfere with the Services or attempt to gain unauthorised access to them

4. Purchases and Virtual Items

Purchases in our games are processed by Apple or Google, not by us. Virtual currency and virtual items are a limited licence to use them within the game; they have no monetary value, cannot be redeemed for cash, and do not transfer between games or outside the game.

Subscriptions renew automatically until cancelled. Cancel through the store that billed you — see Support for step-by-step instructions. Cancelling stops future renewals; access continues until the end of the paid period.

Refunds are handled under the policy of the store that took your payment. Where consumer law in your country gives you a statutory right of withdrawal or refund, nothing here limits it.

5. Intellectual Property

The games, their code, art, audio, and the Buena Games name and marks are owned by Buena Labs Inc. and its licensors, and are protected by copyright and trade mark law. These Terms grant you no rights in them other than the licence in section 2.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without obligation to you. You keep ownership of any content you create and share through a game's features, and grant us a licence to host and display it for the purpose of operating the game.

6. Availability and Changes

We may update, suspend, or discontinue a game or feature. Where we shut a game down permanently, we will give reasonable advance notice in the game or by email where we hold your address, and we will handle any unused paid virtual currency in line with applicable consumer law.

7. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability arising out of or relating to the Services is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50. We are not liable for indirect, incidental, special, consequential, or punitive damages.

Some jurisdictions do not allow these exclusions. Where that is so, the exclusions apply only to the extent permitted, and nothing here limits liability for death, personal injury, or fraud.

8. Termination

You may stop using the Services at any time and delete your data as described on our Data Deletion page. We may suspend or terminate access if you breach these Terms or if we are required to by law. Sections 5, 7, 9, and 10 survive termination.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by a recognised arbitration body in Wilmington, Delaware, USA, under its applicable rules.

Class action waiver. You and Buena Games agree to bring disputes only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

Small claims exception. Either party may bring an individual action in small claims court instead of arbitration if the dispute qualifies.

EU and UK consumers. Nothing in these Terms limits your statutory consumer rights, including the right to bring proceedings in the courts of your country of residence.

10. Changes to These Terms

We may revise these Terms. We will update the "last updated" date and, for material changes, give notice in the affected game or by email before they take effect. Continuing to use the Services after a change takes effect means you accept the revised Terms.
